LGPS Rule of 85 Explained

Understand the membership test, which benefits may have protection and what to ask your pension fund before choosing a retirement date.

What is the LGPS Rule of 85?

The Rule of 85 is an early-payment protection for some people with historic LGPS membership. Your age plus qualifying membership must reach 85, but that total alone does not establish which benefits are protected.

Check three things: your membership dates, the date you want to take benefits, and the pension built up in each protected period. Your fund provides the actual entitlement calculation.

How the age-and-membership test works

Age and qualifying membership are counted in whole years. For a straightforward example:

Age 60 + 25 qualifying years = 85

Arithmetic examples only; these do not confirm entitlement.
AgeQualifying yearsTotalWhat this tells you
602585The total reaches 85; protection still needs checking.
622385A different combination reaches the same total.
602484The total is below 85. Some transitional protection may still reduce the normal early-payment adjustment.
592685The total reaches 85, but full voluntary retirement before 60 has an employer-discretion issue.

Who may qualify?

National LGPS guidance identifies membership at some point between 1 April 1998 and 30 September 2006 as relevant to potential protection.

Do not confuse that with having pre-2008 benefits. Someone who joined during 2007 can have pre-2008 pension and automatic cash without that joining date establishing Rule of 85 protection.

See national LGPS Rule of 85 guidance. Membership history and the applicable transitional rules determine the answer.

Part-time work and deferred pensions

Part-time members

Use calendar membership for this test, without halving it for half-time work. For example, 20 calendar years at half-time remain 20 years for the membership test; the amount of pension built up is a separate calculation.

Deferred members: time after leaving can matter

If you have left the scheme, the Rule of 85 calculation can include notional membership after leaving. Simply adding your age to paid membership at the leaving date can give an incomplete answer.

Ask your fund for the membership that counts and the date your protection becomes relevant. Separate accounts, transfers and rejoining can affect that assessment.

Can I retire at 55, 60 or later?

The membership test and access to benefits are separate questions. For full voluntary retirement before 60, Rule of 85 protection does not automatically apply: the employer's policy and decision matter.

Flexible retirement has separate rules and requires employer agreement. Protection can apply to benefits already built up when flexible retirement first starts; new benefits earned afterwards are outside that protection.

The normal minimum pension age is currently 55 and is due to become 57 from 6 April 2028, subject to exceptions. Check the exact proposed retirement date with your fund.

Which parts of my pension are protected?

The answer varies with birth date, service periods and transitional conditions. A pension can contain benefits with different treatment:

Benefit periodWhat to check with your fund
Before April 2008Whether Rule of 85 protection applies to pension and automatic cash from this period.
April 2008 to March 2020Whether birth-date conditions and transitional or tapered protection affect some of these benefits.
April 2020 onwardsThese benefits generally have no Rule of 85 protection. Do not assume older protection removes their early-payment reduction.

For most members, pre-2014 benefits have a protected Normal Pension Age of 65. Post-2014 CARE benefits use State Pension age, with a minimum of 65. Those pension ages are distinct from Rule of 85 protection.

See the LPPA protection summary and national pension-age guidance.

It does not price your Rule of 85 protection. Active-member membership indications use simplified assumptions; deferred-member messages signpost the extra fund calculation. A protected fund quotation may differ from the standard figures shown here.

What to ask your pension fund

Have your latest statement and proposed retirement date ready. Ask:

  1. Which of my pension accounts have Rule of 85 protection?
  2. What qualifying membership and protected retirement date have you used?
  3. How much pension and automatic cash comes from each service period?
  4. Which early-payment reductions remain after protection?
  5. Would retiring before 60 require an employer decision?
  6. Can you quote my pension at two dates so I can compare the difference?

Rule of 85 questions

Does the Rule of 85 always mean age 60 and 25 years?

No. That is one combination. Age 62 and 23 qualifying years also total 85. Eligibility, the type of retirement and the benefits protected still need separate checks.

Does part-time work halve my Rule of 85 membership?

No. Part-time membership counts at its full calendar length for this test. That is different from how the amount of pension is worked out.

Can teaching assistants qualify for the Rule of 85?

Potentially, if their LGPS membership history meets the conditions. A job title alone does not determine protection. This guide covers the LGPS in England and Wales.

Does the Rule of 85 apply to deferred pensions?

It can. The test can include notional membership after leaving, so do not rely only on paid membership at the leaving date. Ask your fund for your protected retirement date.

Can this website calculate my exact Rule of 85 pension?

No. Our LGPS simulator models standard reductions and retirement scenarios. Your fund must calculate the protected benefits using your full record, dates and any employer decisions.
